The requirements for telecommunications contracts are constantly changing due to the development of legal bases, case law and consumer interests. We want to respond to this change and are specifically addressing relevant topics in the area of telecommunications contracts and customer management in our working and project groups.

Currently, the focus is particularly on the implementation of the Accessibility Enhancement Act (BFSG) and the contract durations of telecommunications service contracts in connection with home connections. While the specific scope of obligations and implementation options under the Accessibility Enhancement Act (BFSG) remain unclear, there is an urgent need for clarification regarding the bundling of contracts with home connections.

FAQ

The BFSG must be implemented by 28.06.2025. However, there is still a lack of a clearly defined scope of obligations and concrete options for implementing some of the requirements. We are in close contact with the relevant authorities and are working towards an intensive collaboration to resolve the open questions.

Within our “Task Force BFSG”, we regularly provide information on new developments and offer a space for the exchange of experience and best practice between our member companies.

For several years, BREKO has regularly informed its members about the current case law on this contractual issue, both through the Regulatory Working Group and through separate informational events. New developments are continually addressed and possible solutions, such as the decoupling of contracts, are presented.
